General In these Terms and Conditions (the “Conditions”) the following words, where used, shall have their corresponding meaning: “Buyer” the person(s), firm or company who purchases the Goods from the Company. “Company” CNN Health Products Limited, registered in England and Wales. Registration number 6923948. “Goods” any Goods agreed to be supplied to the Buyer by the Company (including any part or parts of them). “Contract” any agreement between the Company and the Buyer for the sale and purchase of the Goods, incorporating these Conditions.

CNN Health products Limited reserve the right to via web order or phone orders: Change or remove (temporarily or permanently) the web site (or any part of it) without notice to you and you confirm that we shall not be liable to you for any such change or removal: and/or

Change these Terms & Conditions of Use at any time, and your continued use of the Web site following any change shall be deemed to be your acceptance of such change. We reserve the right to hold any order due to checks made on personal details.

Items sold by CNN Health Products are dispatched from the UK and can only be dispatched to locations within the UK (England, Northern Ireland, Scotland, Wales and all BFPO addresses) and the European Union. All purchases made by you are completed and performed in the UK and UK law shall govern every aspect of contractual agreement concerning purchases made from us.

Please note that we have no control over any additional charges for customs clearance (if applicable) and cannot predict what these may be at any time in the future. Being the importer of the product(s) you are responsible for these charges and for complying with all laws and regulations of the UK Customs Authorities.

Our contract When you place an order on our website to purchase goods from us that constitutes an “Offer to Buy” from you. We accept this order when we send you an “Order Confirmation” (or “Shipment”) email confirming that we have dispatched the goods you have ordered from us. That acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation (or Shipment) email, whether you receive that email or not.

Online Payments You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment, we will not be liable for any delay or non-delivery and we are not obliged to inform you of the refusal.

We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment.

The price for the goods as set on the Web site includes VAT for EU deliveries. We are not responsible for any other importation taxes, sales taxes or charges that may be levied at the delivery destination. Our VAT number is 777975742.

Delivery Time CNN Health Products items are usually delivered within 5-10 business days. Please bear in mind these are approximations and during busy periods delivery may be slightly longer. Please note that we will need to wait 20 days from the date of ordering before we can investigate the non arrival of any item(s). All estimations are naturally Stock permitting.

Prices All prices are inclusive of VAT where applicable. Costs of carriage are those applicable at the time, as advertised at the point of order.

Import Duty and VAT The prices payable for goods as set out in the web site are, inclusive of VAT with any shipping/handling costs also listed.

Payment Payment is currently required when you place your order. We will send you a delivery note setting out the cost of your purchase we have supplied, together with the total cost of postage and packaging if applicable. Ownership and title All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises. All sales are ex works. This means that the sale is completed when the product leaves our premises. The Delivery Date is approximate only and time for delivery shall not be of the essence unless previously agreed by the Seller in writing. The Goods may be delivered by the Seller in advance of the expected Delivery Date. Where the Goods are to be delivered in instalments, each delivery shall constitute a separate contract and failure by the Seller to deliver any one or more of the instalments in accordance with these Conditions or any claim by the Buyer in respect of any one or more instalments shall not entitle the Buyer to treat the Contract as a whole as repudiated. If the Buyer fails to take delivery of the Goods or any part of them when the goods are delivered or a delivery is attempted and/or fails to provide any instructions, documents, licenses, consents or authorisations required to enable the Goods to be delivered, the Seller shall be entitled upon given written notice to the Buyer to arrange for the storage of the Goods and then notwithstanding the provision of Clause Retention of title risk in the Goods shall pass to the Buyer, delivery shall be deemed to have taken place and the Buyer shall pay to the Seller all costs and expenses including storage and insurance charges arising from such failure. Delivery & Risk We dispatch items ordered by you as they are available using Royal Mail in the UK or our chosen courier and Airmail or Express Carrier outside of the UK. The delivery charge is as set out in the Deliveries section. The Couriers will attempt to deliver your parcel and will request a signature. If for any reason the courier can not attain a signature at the requested delivery address they will leave your parcel safe with a neighbour or in a safe place. A card will be placed through the requested delivery address stating the destination of your parcel.

Orders will be sent to the delivery address that you have registered in “YOUR ACCOUNT”. We cannot be held responsible if this delivery address is wrong. If you wish to change the delivery address you may do so by entering the new details in the “YOUR ACCOUNT” section. If you wish to change your delivery address and an order is “IN PROGRESS” you must contact the Customer Services team.

We will use our reasonable endeavours to ensure that the estimated delivery times set out in the Deliveries section are met but we cannot accept any liability for late deliveries.

Deliveries do not include insurance for loss or damage. You the customer take all responsibility for any loss or damage that may occur. CNN Health Products cannot be held responsible for any loss or damage.

Damage / Loss in Transit The Company accepts no liability for any loss resulting from the Buyer’s failure to comply with our carrier’s requirements with respect to notification of damage, shortage or non delivery of Goods.

Goods should be inspected on receipt and damage/shortages advised in writing to the carriers and ourselves within 3 days.

Damaged Goods must be retained for inspection at the company’s discretion.

Damaged Goods returned to the company will only be accepted if previously agreed in writing.

Non delivery must be advised in writing to the carriers and ourselves within 10 days of date of order.

Delivery – Customer not present If delivered via courier delivery will be attempted twice (2) third time deliveries will be charged at £4.50. Change of address after the order has been made will be charged at £12.00. Risk and Title Risk shall pass to the Buyer when the Goods are delivered to or collected by the Buyer or his agent. Retention of Title It is a term of the Contract for sale of any Goods herein that the Goods shall remain the property of the Seller until such time as payment in full has been received and cleared. In the event of any default in payment the Seller reserves the right to reclaim the Goods concerned.

Electronic communications When you transact with CNN Health Products or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the www.top-supplements.co.uk website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your legal rights.

Alteration of service or amendments to the conditions we reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Events beyond our reasonable control We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your legal rights.

Waiver If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing law and jurisdiction Use of CNN Health Products is governed by English Law and the parties submit to the exclusive jurisdiction of the English Courts in any dispute which may arise concerning the Contract. Security & Privacy you should review our Security Policy & Privacy Policy (which, for the avoidance of doubt, do not form part of these Terms & Conditions of Trade).

Changes To These Terms & Conditions Of Trade We may change these Terms & Conditions of Trade at any time.

Returns & Refunds Policy If you return goods to us, unopened, within 1 week of dispatch we will refund the amount charged. We do advise you obtain proof of posting from your local post office. Please note we can only refund your money in cases where; 1) goods have been damaged; 2) goods have been incorrectly dispatched. We regret that no refunds will be given on products already opened.

Cancellations Orders are processed almost as soon as they are placed and it is not possible to cancel or change an order on the website once it has entered the dispatch process. If you no longer want the item you ordered, please return the item to us in accordance with our Returns & Refunds Policy and you will receive a full refund for the price you paid for the item(s) minus the delivery charge.

Right to Withdraw Items We reserve the right to withdraw any items from the Web site at any time.

We will not be liable to you or anyone else for withdrawing any items from the Web site or refusing to process an order.

You should check any received goods on arrival to ensure that they are not faulty.

Prices that are reduced for sales and promotions are only valid for the specified period.
